1. Acceptance of terms

These Terms and Conditions govern your use of Dellco Commercial Kitchens website and purchases from the store. By accessing the website, creating an account, or placing an order, you agree to these terms and the policies linked from them. If you do not agree, do not use the website or purchase products.

2. Store eligibility

You must have legal capacity to enter a binding agreement and must use the store only for lawful purposes. Refrigerant products are intended for persons and organizations that satisfy all purchase, handling, installation, resale, and use requirements applicable to them.

3. Account responsibilities

You are responsible for accurate account information, maintaining credential confidentiality, and activity under your account. Notify us if you suspect unauthorized use. We may restrict or terminate access when reasonably necessary to protect the store, customers, or legal compliance.

4. Product information

We work to present accurate product titles, descriptions, specifications, images, packaging, and documentation. Colors, labels, packaging, and appearance may vary by manufacturer or production run. Review the current product information and Safety Data Sheet before purchase and use.

5. Product availability

Products and quantities are subject to availability. Displaying a product does not guarantee that it can be supplied in the requested quantity or shipped to every destination. We may limit quantities or cancel unavailable items and will address any related payment according to the transaction status.

6. Prices

Prices are displayed in U.S. dollars unless stated otherwise and may change without notice. The price applicable to an accepted order is the price shown during checkout, subject to correction of obvious errors and any tax, shipping, handling, or other charge disclosed before order submission.

7. Errors and corrections

We may correct typographical, pricing, inventory, image, specification, or other errors. If a material error affects an order, we may contact you for instructions or cancel the affected item and address any payment already made.

8. Orders

By submitting an order, you offer to purchase the selected products and confirm that the information supplied is accurate and complete. You are responsible for reviewing product, quantity, address, eligibility, and contact details before submitting.

9. Order acceptance

An automated confirmation means the order was received, not necessarily accepted. Acceptance may depend on availability, payment authorization, destination, customer information, purchase restrictions, and operational review. A shipment notice or other express confirmation indicates acceptance of the shipped items.

10. Order cancellation

We may refuse, limit, hold, or cancel an order when reasonably necessary for availability, suspected fraud, payment failure, inaccurate information, regulatory concerns, destination restrictions, pricing errors, safety, or misuse. Customers may request cancellation, but it cannot be guaranteed after fulfillment begins.

11. Payment

You authorize the payment method selected at checkout for the amount disclosed. A payment service may perform authorization, verification, fraud screening, settlement, and refund processing under its own terms. We may require payment confirmation before fulfillment.

12. Taxes

You are responsible for sales, use, excise, or other taxes and governmental charges that apply to the transaction, except taxes imposed on our net income. Amounts collected by the store are based on the information available at checkout and applicable requirements.

13. Shipping

Shipping is governed by our Shipping Policy. Refrigerant transport may be subject to carrier, route, destination, and hazardous-material requirements. Provide a complete deliverable address and monitor tracking and delivery attempts.

14. Delivery estimates

Normal processing is 3–5 business days, estimated transit is 5–8 business days, and the combined estimate is 8–13 business days. Estimates are not guarantees and may be affected by verification, availability, carrier operations, weather, emergencies, or other conditions.

15. Risk of loss

Risk of loss and title pass as provided by applicable law and the shipping terms for the transaction. This section does not limit any nonwaivable consumer right or a valid claim for a shipment confirmed lost or damaged under our policies.

16. Returns and refunds

Returns, restocking fees, inspection, damaged items, and refunds are governed by the Refund and Return Policy, including its 30-day request period, condition rules, authorization requirement, and 25% restocking fee for eligible returns not caused by our error.

17. Refrigerant-purchase responsibilities

You are responsible for determining and satisfying the requirements that apply to purchasing, receiving, handling, installing, reselling, and using refrigerants. By ordering, you represent that the product will be installed by, or resold to, an EPA-certified technician when required and that you will comply with applicable law.

18. Compliance with applicable requirements

You must comply with federal, state, local, environmental, transportation, workplace, licensing, certification, recordkeeping, recovery, recycling, disposal, and safety requirements applicable to your activities. Product information is not legal, regulatory, or professional advice.

19. Prohibited uses

You may not use the website or products to violate law, infringe rights, transmit harmful code, interfere with security or operation, collect information without authority, misrepresent identity or eligibility, place fraudulent orders, or facilitate an unlawful purchase, transfer, handling, or release.

20. Website content

Website content is provided for general product and store information. Although we seek accuracy, content may not be complete, current, or suitable for every application. Always consult the product label, manufacturer documentation, Safety Data Sheet, qualified professionals, and applicable requirements.

21. Intellectual property

The website design, text, original graphics, logos, and other content are owned by Dellco Commercial Kitchens or used with permission and are protected by applicable intellectual-property law. 27. Severability

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.

29. Governing law

These terms are governed by applicable federal law and the laws of the State of New York, without regard to conflict-of-law principles, except where another law must apply or a nonwaivable right provides otherwise.
